The Nigerian Bar Association (NBA) has reaffirmed its stance on the declaration of a state of emergency in Rivers State, insisting that the action of President Bola Tinubu on March 18, 2025, was unconstitutional, illegal and negates known democratic norms.
NBA President, Mazi Afam Osuigwe (SAN), stated this in a statement jointly released, yesterday, with the General Secretary, Dr. Mobolaji Ojibara, and Emeka Obegolu (SAN) Chair, NBA Annual General Conference Planning Committee.
The NBA hierarchy spoke against the backdrop of change of venue of its 2025 Annual General Conference from Port-Harcourt to Enugu.
With the suspension of Governor Siminalayi Fubara, his deputy, and the State Assembly in Rivers State, the NBA said it cannot go ahead to host it’s AGC in Port-Harcourt again.
“Currently, Rivers State is being governed by a retired military officer, appointed as a Sole Administrator, who operates with a command-style approach that disregards constitutional provisions, court decisions, and pending litigation.
“His actions have undermined democratic institutions and processes, flouting the rule of law with impunity.
“Though clad in civilian attire, he governs as though the state is under military rule” the NBA stated.
